1.          Scope

These General Terms and Conditions (hereinafter "Terms and Conditions") apply to all contracts concluded between Devine Design (hereinafter "Seller" or "we") and the customer (hereinafter "Customer" or "you") via the websites : devine-design.net; beaux-la-lux.com;

dream-art-light.com; dream-light-creations.com; ginger-palms-design.com (hereinafter “website”) will be closed. Differing conditions from the customer only apply if they are expressly acknowledged in written form by the seller.

 2.          Conclusion of contract

2.1.      The presentation of the objects on the website does not constitute a legally binding offer, but rather an invitation to order (invitatio ad offerendum).

2.2.      By submitting an order via the website, the customer makes a binding offer to conclude a purchase contract. Seller may accept or reject this offer at

its sole discretion.

2.3.      After receipt of the order, the customer will be informed by email that the order has been received. This email does not constitute acceptance of the

offer, but merely serves to confirm receipt of the order.

2.4.      A contract is only concluded when the seller confirms the order by shipping the goods or by an express declaration of acceptance by email.

3.          Prices and payment terms

3.1.      The prices stated on the website are in euros (€) and include VAT. Products shipped to customer´s country may be subject to additional VAT charges

and, if applicable, customs duties in your country. If Devine Design is legally required to collect VAT on your order, you will see VAT-inclusive prices when confirming your order. To require further information about these costs, it´s the customer´s obligation to contact the tax and customs authorities in his country.

3.2.      The customer can make payment via the payment method conditions, which  are indicated on the website.

3.3.      The purchase price is due immediately after conclusion of the contract.

4.          Delivery and shipping costs

4.1.      The ordered goods will be delivered to the delivery address specified by the customer.

4.2.      The shipping costs are shown on the website and will be communicated to the customer before completing the order.

Currently we offer delivery worldwide free of charge.

4.3.      It is understood that with regard to worldwide deliveries, no exact delivery time can be scheduled. The approximate delivery time is indicated on the

website. However, we guarantee the fastest possible processing. The seller endeavors to comply with these, but cannot responsibly guarantee.

 5.          Right of withdrawal and refund

5.1.      You have the right to cancel this contract in accordance to statutory regulations without giving any reasons.

 The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

5.2.     In order to exercise your right of withdrawal, you must contact us by means of a clear statement about your decision to withdraw from this contract

by acceptance of electronic communication to:   info@devine-design.net.

In order to meet the cancellation period, it is sufficient that you send the notification of exercising the right of withdrawal before the expiry of the withdrawal period. If you make use of this option, we will send you a confirmation of receipt that revocation within 2 working days by email.

5.3.     If you cancel this contract, we will refund your payments, except delivery costs (by proven statement of the shipping company) to be repaid as soon

as possible from the day on we received the goods back according to your notification of your cancellation of this contract. For this repayment we use the same payment method that was used for the original transaction unless something different is expressly agreed with you.

5.4.     We can refuse the refund as long as we have not received the goods back.

5.5.     You must return or hand over the goods to us in any case no later than fourteen days from the day on which you inform us of your cancellation of this

contract. The deadline is met if you send the goods before the fourteen day period has expired. Return adress will be delivered together with the above mentioned acceptance (receipt of revocation) of your withdrawal.

5.6.     Customer is liable for any loss in value of the goods by non appropriate handling.

5.7.     The customer shall bear the direct costs of returning the goods.

5.8.     The delivered goods remain the property of the seller until full payment has been made.

6.          Risk of loss

All purchases of physical items are made pursuant to a shipping contract.

In the event of partial or total loss in transit, Devine Design will be liable in the form of offering you an adequate replacement. If you do not wish to accept this, we will refund the purchase price.

 7.         Disputes

7.1.      We are neither prepared nor obliged to participate in any dispute resolution proceedings before a consumer arbitration board.

7.2.      Any dispute or claim relating in any way to your use of the Devine Design Service shall be resolved by court

located in Las Palmas, Gran Canaria, Canary Islands, Spain and you consent to exclusive jurisdiction and venue in such courts.

 8.          Warranty and Liability

 The statutory warranty regulations of the state of Spain apply.

 After proven delivery at destination the customer is liable for damages in the event of gross negligence or intent.

 9.          Data protection

The seller processes the customer's personal data only in accordance with the applicable data protection laws. The details can be found in the data protection declaration, which can be viewed on the website.

 10.        Final provisions

10.1.    The law of the state of Spain applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes arising from and in connection with this contract is Las Palmas, Gran Canaria, Canary Islands, Spain.   

10.2.    If individual provisions of these General Terms and Conditions are or become ineffective, the effectiveness of the remaining provisions remains

unaffected. The invalid provision is replaced by a regulation that comes closest to the economic meaning and purpose of the invalid provision.

10.3.    These terms and conditions can be changed by the seller at any time. The current version can be viewed on the website.
